Investigative outcomes depend on factors outside our control, including the actual behavior of the subject, the availability of public records, the cooperation of witnesses, and the timing of observation.

You should treat any investigator who guarantees results as a red flag: such guarantees often signal willingness to fabricate evidence, use illegal methods, or mislead the client to secure payment. Our commitment is a diligent, lawful investigation with a factual, defensible written report β€” not a predetermined conclusion. 6. Payment, Retainer, and Billing Terms

All engagements are governed by a written engagement letter or proposal agreed to by the client before any investigative work begins. Standard terms include:

  • Retainer: most engagements require an upfront retainer ($1,500–$5,000 for typical matters, higher for complex or long-running cases) deposited into our client trust account and drawn down against billable time and expenses. The specific retainer for your matter is scoped in the engagement letter.
  • Hourly billing: billable time includes active investigation, travel to and from observation locations, report writing, and case documentation. Rates are disclosed in the engagement letter and, for reference, typically fall in the $100–$175/hour range for surveillance and mid-complexity work.
  • Flat-fee services: background checks, process service, and certain other scoped tasks are billed at a flat fee disclosed before the work begins β€” no hourly creep.
  • Pass-through expenses: mileage (at the IRS standard rate), court-filing fees, PACER and database-query fees, specialized-equipment rental, and any other out-of-pocket costs are passed through at actual cost without markup, with receipts available on request.
  • After-hours premium: work performed on weekends, holidays, or outside standard business hours (before 7 AM or after 9 PM local time) may be billed at 1.5Γ— the standard rate, disclosed in the engagement letter.
  • Invoicing: invoices are issued at case milestones or at regular intervals (weekly or bi-weekly for active matters) and are due within 15 days of receipt unless otherwise negotiated. Past-due balances may accrue interest at the maximum legal rate.
  • Unused retainer refund: any portion of the retainer not consumed by billable time and expenses is refunded to the client within 30 days of case closure.
  • Scope changes: material scope changes (e.g., additional surveillance days, added subjects, extended digital-forensics scope) require a written scope-change addendum before additional work proceeds, with an updated budget cap where applicable.
